I’d be rich if I had a cent for every time I heard a lawyer joke! Lawyers seem to have a bad reputation, sometimes seen as a “necessary evil”.

Here are my pet hates about my profession. What are yours?

1. No promises, no guarantees

With other professional services, clients can often be guaranteed, or at least be reasonably certain, of a particular result.  However, lawyers can never be certain of anything.  This is a problem, since that’s why you went to the lawyer in the first place, right? To get an answer to your question.  The realities are that, not only is it ethically wrong for a lawyer to provide a guarantee, but the legal system is an unpredictable beast.  No case is a sure thing.

2. Lack of empathy.

In To Kill a Mockingbird, the wise lawyer Atticus Finch said that “you never really understand a person until you consider things from his point of view…until you climb into his skin and walk around in it.”  Sometimes, after having dealt with a client’s particular legal situation many times before, some lawyers may lose the ability to empathise with their clients, possibly coming across as uncaring or unsympathetic. The best lawyers will always treat their client as if they were the most important thing in the world … because they are.

3. Apocalypse mentality.

Lawyers are eternal pessimists and when you walk out of a lawyer’s office, you may feel as though the Zombie Apocalypse is coming.  Your lawyer will have painted the worst possible scenario of what might happen.  While it is, in fact, the lawyer’s job to advise their clients of all the things that could possibly go wrong, clients often feel unnecessarily scared about their legal problem. However, you would rather have all the facts and be able to make an informed decision, right?

4. Talk talk talk

The biggest complaint my partner has about me is that I over-complicate everything I say.  OK, that’s not the biggest complaint she has, but her point is that lawyers have a tendency to waffle.  After all, we have spent years reading wordy judgements about snails in ginger-beer bottles, so we may find it difficult to simplify things and explain them in easy, everyday language.

5. Charging for phone calls

“It was only a 3-minute call”, said the client, “and you charged me for it!”  A common complaint about lawyers is that they charge every time you call them or they call you, even if it is only for a few minutes to follow up on some issue or another.  While it is annoying to be charged for such short conversations, the truth is that your lawyer has to also record what was said or what advice was given, and this takes time.  By the end of it, the “3-minute” conversation you remember has actually taken 10 or 15 minutes of your lawyer’s time.
